This article analyses the policies and the use of social rights in France and Germany in relation to the philosophical conception of subjective rights theorised by Catherine Colliot-Thélène. The first part is devoted to the relationship between the innate right and the solidarist conception of social citizenship, which is institutionalised and evolves within the framework of the “labour society” in both countries. The second part deals with the differences and developments in the French and German regimes of social citizenship and (...) policies of access to rights. In recent times, social rights have been redefined as fundamental rights and form part of a renewed conception of citizenship. In the third part, we study the implementation of schemes of access to social rights and their agents in Berlin, Paris and the Paris region, focusing on the case of “poor migrants”. (shrink)

Scientists often communicate using generic generalizations, which are unquantified generalizations such as ‘Americans overestimate social class mobility’ or ‘sound waves carry gravitational mass’. In this paper, I explain the role of such generic generalizations in science, based on a novel theory about their characteristic meaning. According to this theory, a scientific generalization of the form ‘Ks are F’ says that F is one property based on which category K qualifies as a scientific kind. Because what it takes to qualify as (...) a scientific kind varies depending on the discipline, what a generic sentence entails also varies. Based on this semantic theory, I discuss the benefits and drawbacks of using generic language in science. (shrink)

This paper supports the personal data platform cooperative as a means of bringing about John Rawls’s favoured institutional realisation of a just society, the property-owning democracy. It describes personal data platform cooperatives and applies Rawls’s political philosophy to analyse the institutional forms of a just society in relation to the economic power deriving from aggregating personal data. It argues that a society involving a significant number of personal data platform cooperatives will be more suitable to realising Rawls’s principle of fair (...) equality of opportunity. (shrink)

The study of classes of models of a finite diagram was initiated by S. Shelah in 1969. A diagram D is a set of types over the empty set, and the class of models of the diagram D consists of the models of T which omit all the types not in D. In this work, we introduce a natural dependence relation on the subsets of the models for the 0-stable case which share many of the formal properties of forking. This (...) is achieved by considering a rank for this framework which is bounded when the diagram D is 0-stable. We can also obtain pregeometries with respect to this dependence relation. The dependence relation is the natural one induced by the rank, and the pregeometries exist on the set of realizations of types of minimal rank. Finally, these concepts are used to generalize many of the classical results for models of a totally transcendental first-order theory. In fact, strong analogies arise: models are determined by their pregeometries or their relationship with their pregeometries; however the proofs are different, as we do not have compactness. This is illustrated with positive results as well as negative results . We also give a proof of a Two Cardinal Theorem for this context. (shrink)

Three experimental studies are reported in which we tested the prediction that negative emotion elicits the social sharing of the emotional experience. In two experiments, participants arrived at the laboratory with a friend and then viewed one of three film excerpts (nonemotional, moderate emotion, or intense emotion) alone. Afterwards, the participants who saw the film had an opportunity to interact with the friend and their conversation was recorded. In both experiments participants who had seen the intense emotion excerpt engaged in (...) significantly more social sharing than did participants in the other two conditions. A third experiment extended the investigation to social sharing in everyday life and replicated the previous results. Nonemotional explanations of the effects observed were also ruled out. Results are discussed in the context of the relation between emotional intensity and amount of social sharing. (shrink)

Comment interpréter le regain d'intérêt pour les réflexions sur la transcendance, la quête de sens, la morale et l'éthique dans nos sociétés contemporaines? We make physical efforts when we swim, carry shopping bags, push heavy doors, or cycle up hills. A growing concern among philosophers and scientists in related fields is the absence of a well-defined concept for physical efforts. This paper addresses this issue by presenting a force-based definition of physical efforts. In Sect. 1, we explore the shortcomings of existing definitions of effort. Section 2 introduces the force-based account of efforts according to which making an effort consists in exerting a force (...) so as to make an object move or stay at rest. Section 3 introduces three central distinctions stemming from the account: failed vs. successful efforts; resisted vs. unresisted efforts; and efforts vs. effortful actions. Section 4 presents a key objection, to the effect that the force-based theory cannot account for the difficulty of efforts: efforts usually feel difficult, but effort’s difficulty is not always a function of the magnitude of force(s) exerted. Section 5 argues that the most in-depth account of difficulty so far, that developed by Bradford ( 2015 ), cannot account for the difficulty of efforts. Sections 6 & 7 develop a novel account of effort’s difficulty. (shrink)

The theoretical literature on vertical relationships usually assumes that beliefs about secret contracts take specific forms. In a recent paper, Eguia et al. (Games Econ Behav 109:465–483,2018) propose a new selection criterion that does not impose any restriction on beliefs. In this article, we extend their criterion by generalizing it to risk-averse retailers, and we show that risk aversion modifies the size of the belief subsets that support each equilibrium. We conduct an experiment which revisits that of Eguia et al. (...) (Games Econ Behav 109:465–483,2018). We design a new treatment effect on equilibrium selection depending on the retailers’ risk sensitivity. Experimental results confirm the treatment effect: the more sensitivity there is towards risk, the more the equilibrium played is consistent with passive beliefs. In addition, extending Eguia et al.’s (Games Econ Behav 109:465–483,2018) criterion to risk-averse retailers improves its predictive power on the equilibria played, especially for a population of retailers with moderate to extreme risk aversion. This paper explores the use of Popper's philosophy of science by cladists in their battle against evolutionary and numerical taxonomy. Three schools of biological systematics fiercely debated each other from the late 1960s: evolutionary taxonomy, phenetics or numerical taxonomy, and phylogenetic systematics or cladistics. The outcome of that debate was the victory of phylogenetic systematics/cladistics over the competing schools of thought. To bring about this "cladistic turn" in systematics, the cladists drew heavily on the philosopher K.R. Popper in order to (...) dress up phylogenetic systematics as a hypothetico-deductivist, indeed falsificationist, research program that would put an end to authoritarianism. As the case of the "cladistic revolution" demonstrates, scientists who turn to philosophy in defense of a research program read philosophers with an agenda in mind. That agenda is likely to distort the philosophical picture, as happened to Popper's philosophy of science at the hands of cladists. (shrink)

In order to understand the place Max Scheler occupied in the debates of his time around the notion of Europe, this article aims to shed some light on the possible convergences between Max Scheler and Rudolf Eucken, who was his thesis director at Jena. The article begins by outlining Rudolf Eucken's conception of Europe, then it identifies a number of points in common between the two authors, before finally measuring the extent of these convergences in Scheler's conception of Europe. At (...) the end of the discussion, it appears that the reception of Augustinianism and a shared conception of community reveal interesting links between the two authors. This connection will give the twenty-first-century reader a better understanding of the framework in which Max Scheler's reflections on Europe are set. (shrink)

ABSTRACTThe presence of emotional words and content in stories has been shown to enhance a story’s memorability, and its cultural success. Yet, recent cultural trends run in the opposite direction. Using the Google Books corpus, coupled with two metadata-rich corpora of Anglophone fiction books, we show a decrease in emotionality in English-speaking literature starting plausibly in the nineteenth century. We show that this decrease cannot be explained by changes unrelated to emotionality, and that, in our three corpora, the decrease is (...) driven almost entirely by a decline in the proportion of positive emotion-related words, while the frequency of negative emotion-related words shows little if any decline. Consistently with previous studies, we also find a link between ageing and negative emotionality at the individual level. (shrink)

Apprendre, c'est d'abord élever et s'élever puisque, en français, apprendre a toujours le sens passif (s'instruire) et actif (instruire). Apprendre, c'est ensuite enseigner : il s'agit d'une éducation, intentionnelle, méthodique, programmée. Apprendre, c'est aussi former. Ce verbe correspond avant tout à l'apprentissage d'un métier. Apprendre, c'est enfin échanger, imiter, s'initier, apprendre à être. Tels sont les enjeux de cette réflexion sur les valeurs de l'éducation conçue comme apprentissage de l'humanité.

On a pris l'habitude de voir en l'analyse un instrument logique de décomposition et de clarification des concepts, confirmant du même coup l'évaluation critique qu'en a donnée Kant : l'analyse est un procédé stérile qui ne contribue en rien à l'expansion et au renouvellement des connaissances. Soulignant la cohérence de ses emplois historiques, le présent ouvrage cherche au contraire à rétablir l'analyse en sa fonction inventive : de l'Antiquité au XVII siècle, la méthode analytique constitue, en effet, une solution aux (...) insuffisances de la déduction logique ; s'appuyant sur la construction et le déchiffrement des figures, elle offre une voie à la fois détournée et probante pour la résolution des problèmes. Descartes est l'héritier de cette tradition, mais il est aussi, à maints égards, l'artisan de la conception moderne de l'analyse dont il a fait la voie privilégiée de la connaissance de soi dans les Méditations métaphysiques. Accomplissement heuristique de "l'ordre des raisons" mais aussi aventure temporelle inscrite dans la durée féconde de la méditation, l'analyse se révèle alors l'instrument d'une raison radicalement inventive. En dépit de sept lois intervenues entre 1988 et 2013 en matière de transparence dans la vie publique et de lutte contre la corruption, la France est caractérisée par un sentiment de banalisation des scandales politiques. Ces derniers, qui conduisent parfois à la démission ou à la condamnation d’un responsable politique, semblent d’abord revêtir une dimension « sacrificielle ». Or cette situation, qui aboutit à ne plus voir dans certains manquements éthiques des scandales politiques ou qui prive ceux-ci, lorsqu’ils éclatent, (...) de leur effet utile pour la construction de l’État de droit, est révélatrice d’une culture juridique française fondée sur une croyance en une « incarnation » du pouvoir. L’objet de l’article est dès lors d’expliquer les raisons de cette spécificité, avant de montrer que le système français promeut lui-même une distinction entre la fonction politique et son titulaire, et l’instauration d’un « censeur » au service de la première. L'actualité sociolinguistique des Départements français de la Caraïbe et de l'Océan indien illustre les contradictions internes qui agitent les sociétés créoles. Elle souligne également la difficulté que rencontrent ces territoires pour envisager leurs rapports entre eux. L'action de l'État destinée à valoriser les langues et cultures régionales dans la République, a relancé le débat public sur la question linguistique dans les aires créolophones françaises. L'existence d'un ou plusieurs créoles, les modalités de son écriture, les critères de sa généralisation dans le (...) cadre de son enseignement comme langue, sont au coeur du débat. Les défenseurs du créole écrit chercheraient à substituer une langue déviante et savante aux langues vernaculaires, niant de fait les particularités linguistiques de chaque territoire au profit d'un espéranto créole. L'analyse du développement d'un mouvement de revendications linguistique et culturelle dans les aires créoles françaises montre l'existence d'une dynamique identitaire revisitée à partir de la diversité culturelle de ces territoiresFrom a sociolinguistic standpoint the French “Departments” of the Caribbean and the Indian Ocean currently illustrate internal contradictions within Creole societies. These territories are also confronted with difficulties in establishing relationships between themselves. State action destined to promote regional languages and cultures in France has renewed public debate on the linguistic issue in French Creole speaking areas. The existence of one or several varieties of Creole, their modes of writing, the criteria of their generalisation in the context of how they are taught as a language, are all at the very centre of the debate. It is possible that the defenders of written Creole try to substitute a deviant and academic language for vernacular languages thus denying in fact the linguistic particularities of each territory in favour of a kind of Creole esperanto. The analysis of the development of a linguistic and cultural movement claiming a better status in French Creole areas shows the existence of revisited identity dynamics from the cultural diversity in those territories. The description of vision occurs in the Timaeus in 45b-47b, following a double pattern characteristic of this dialogue: The physicist first gives a mechanical explanation of sight that involves two fluxes of light, that of the eye and that of the body in the field of vision. He then goes on to give a functionalist explanation that puts vision at the source of the sciences of astronomy, mathematics, and even philosophy. In this complex passage of the Timaeus, vision is a (...) power that informs us how an affection, that gives rise to sensations, could give rise to knowledge. This article begins by investigating the main ideas in passage 45b-47b of the Timaeus and goes on to explain what is at stake in competing interpretations concerning the role of vision in thought in this particular passage. It argues that, through a constitutive dualism between the sensible and the intelligible – implying an epistemological gap – vision is an instrument towards the intelligible. (shrink)

L’œuvre majeure de Johannes Weiss, Die Predigt Jesu vom Reiche Gottes (1892) n’est le plus souvent mentionnée qu’à titre d’exemple d’une découverte exégétique qui n’aurait eu aucune conséquence, chez son auteur, en théologie dogmatique. Après avoir présenté dans leur contexte les thèses principales de cet écrit, l’article critique la représentation – héritée de Schweitzer – d’une « redécouverte » de l’eschatologie, et précise la limite de la proposition théologique de Weiss : si on ne saurait lui reprocher une réinterprétation des (...) représentations du Royaume de Dieu dans la prédication de Jésus, on peut regretter qu’il ne traite celui-ci que comme un thème de la prédication de Jésus, et non comme une relation constituant son identité même. In biological systematics, as well as in the philosophy of biology, species and higher taxa are individuated through their unique evolutionary origin. This is taken by some authors to mean that monophyly is a (relational) property not only of higher taxa, but also of species. A species is said to originate through speciation, and to go extinct when it splits into two daughter species (or through terminal extinction). Its unique evolutionary origin is said to bestow identity on a species through (...) time and change, and to render species names rigid designators. Species names are thus believed to function just like names of supraspecific taxa. However, large parts of the Web of Life are composed of species that do not have a unique evolutionary origin from a single population, lineage or stem-species. Further, monophyly is an ambiguous concept if it is defined simply in terms of ‘unique evolutionary origin’. Disambiguating the concept by defining a monophyletic taxon as ‘a taxon that includes the ancestor and all, and only, its descendant’ renders monophyly inapplicable to species. At the heart of the problem lies a fundamental distinction between species and monophyletic taxa, where species form mutually exclusive reticulated systems, while higher taxa form inclusive hierarchical systems. Examples are given both at the species level and below to illustrate the problems that result from the application of the monophyly criterion to species. The conclusion is that the concepts of exclusivity and monophyly should be treated as non-overlapping: exclusivity marks out a species synchronistically, i.e. in the present time. Monophyly marks out clades (groups of species) diachronistically, i.e. within an historical dimension. (shrink)
